Biography

Robert F. Finkelstein has substantial experience litigating a broad range matters in federal and state courts and before various arbitral and administrative tribunals.  Rob has represented clients in such matters as a multi-million dollar breach of contract claim relating to the theft of intellectual property, the valuation of a close corporation in a buy-out proceeding, breach of multi-million dollar large-scale construction agreements, lien foreclosure actions, enforcement of performance and payment bonds, dissolution of not-for-profit corporations, employment discrimination claims under the Americans with Disabilities Act and related state and federal statutes, will contests in Surrogate’s Court, various regulatory investigations, and numerous contract and employment-related disputes. 

Rob regularly practices in the field of employment law, negotiating and drafting various employment related agreements such as non-competes and separation agreements; counseling clients in connection with employer record keeping requirements and minimum wage/overtime laws pursuant to the Fair Labor Standards Act and related state and local laws; advising on and defending against claims under federal, state and local law concerning allegations of discrimination and requests for reasonable accommodations; analyzing employment related regulations and opinions, including with respect to terminations, disciplinary matters and disability leave; and drafting employee handbooks. 

Rob is further experienced in the area of administrative law, having successfully represented clients in proceedings and hearings before New York’s Department of Health, Board of Pharmacy, and Environmental Laboratory Approval Program (ELAP), as well as Article 78 proceedings and appeals. 

Rob’s business related experience includes representing clients in connection with general corporate matters, trademark registration, and employment related matters.  He regularly negotiates and drafts employment agreements, employee manuals, stock and asset purchase agreements, sales agreements, and licensing agreements.  

Rob graduated in 2000 from Fordham University School of Law where he was a member of the Intellectual Property, Media & Entertainment Law Journal and received The Archibald R. Murray Public Service Award.
